SHUA Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) apply to your (hereinafter referred to as the “User”) use of the services provided by Shuhua Sports Co., Ltd. (hereinafter referred to as “SHUA”) (hereinafter referred to as the “Services”).
Please read these Terms carefully before registering, logging in, or using the Services.
By using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the accompanying Privacy Policy.

1. Service Provider
1.1 The Services are operated and managed by Shuhua Sports Co., Ltd., a company incorporated under the laws of the People’s Republic of China, with its registered address at Shichun Industrial Park, Chidian Town, Jinjiang City, Fujian Province, China.

1.2 Through its digital platforms, SHUA provides the following Services:
1.Collecting, processing, and storing your personal data in remotely accessible cloud systems (the “Database”);
2.Offering personalized training services, exclusive digital fitness content, and assessment questionnaires;
3.Providing the SHUA Community platform for user interaction, sharing, and communication (the “Community”).

2. User Accounts and Personal Data Management
2.1 Account Registration
Use of the Services requires registration of a SHUA account. All data necessary for providing the Services will be collected and managed under your account.

2.2 Account Security
You are responsible for keeping your account credentials and password secure and must not share them with others.

If you discover any abnormal activity or unauthorized use of your account, you must notify SHUA immediately.

SHUA reserves the right to suspend or terminate accounts found to be in violation of laws, regulations, or abusive use of the Services.

2.3 Personal Data Management

2.You agree that we may collect data necessary for the provision of the Services, including but not limited to: registration information, fitness data, device information, and log records.

3. Rules of Service Use
3.1 Information Requirements
You must provide accurate, complete, and up-to-date information when registering, logging in, or using the Services, to ensure effective delivery of the Services.

3.2 Prohibited Conduct
You shall not use the Services to transmit, publish, or distribute:
1.Content that is intimidating, defamatory, obscene, offensive, pornographic, abusive, hateful, discriminatory, threatening, in violation of confidentiality obligations, or invasive of privacy;
2.Content infringing on third-party rights or violating national or international laws and regulations, including but not limited to intellectual property rights, patents, trademarks, or trade secrets;
3.Content that may constitute a criminal offense, be unlawful, violate public order or morality, or infringe upon the rights of others;
4.Content containing viruses, trojans, worms, corrupted data, or other harmful software;
5.Content that infringes upon the name, identity, or misrepresents association with a natural or legal person;
6.Content deemed offensive or objectionable by SHUA;
7.Spam, randomly or automatically generated content, commercial or unethical content, or content encouraging illegal behavior (e.g., phishing), or falsified source information;
8.Content that violates contracts with network service providers or equipment suppliers;
9.Any conduct that disrupts service continuity or constitutes abuse of the Services, including hacking activities.

4. Service Modifications and Updates
4.1 The Services will undergo continuous iteration and improvement. SHUA may modify these Terms at any time and will update the latest version on this page. Please check regularly.

4.2 When new features are released, specific terms may be issued. In the event of any conflict, such specific terms shall prevail.

4.3 The Services may become temporarily unavailable or certain features may fail. SHUA will make reasonable efforts to restore them promptly.

5. User Feedback and Contributions
5.1 Users may provide evaluations, comments, or suggestions regarding the Services (“Feedback”).
5.2 By providing Feedback, you agree that:
Feedback does not contain confidential or proprietary information;
SHUA is under no obligation of confidentiality regarding the Feedback;
SHUA may freely use or disclose the Feedback worldwide;
SHUA may already be developing or have considered similar content;
Feedback shall automatically become the property of SHUA, and you will not be entitled to any form of compensation or reimbursement.

6. Third-Party Services
6.1 The Services may include content or services provided by third parties. Such third parties shall bear sole responsibility for their services.

6.2 SHUA will use reasonable efforts to ensure compliance of third-party services but does not guarantee their availability or reliability.

7. Service Modifications, Suspension, and Termination
7.1 SHUA reserves the right to modify, suspend, or terminate any part or all of the Services for reasons including, but not limited to, business adjustments, technical upgrades, or regulatory requirements.

7.2 Whenever possible, SHUA will provide prior notice or announcements regarding such modifications, suspensions, or terminations.

7.3 In the event of Service termination, SHUA will handle your data in accordance with applicable laws and regulations, as well as the Privacy Policy.

8. Disclaimer
8.1 The Services are intended solely as a fitness and exercise assistance tool and do not constitute any medical diagnosis, treatment, or professional medical advice. Users should exercise responsibly according to their own health conditions and consult a physician when necessary.

8.2 SHUA shall not be liable for any personal injury, property damage, or other losses arising from the user’s own actions, health conditions, improper operation, or environmental factors.

8.3 SHUA shall not be liable for service interruptions or data loss caused by force majeure events or third-party actions, but will make reasonable efforts to minimize such losses.

9. User Rights and Obligations
9.1 Users are entitled to use the features and Services provided by the App within the limits permitted by applicable law.

9.2 Users have the right to provide feedback and suggestions, and SHUA will continuously improve the Services based on such feedback.

9.3 Users must comply with these Terms and all applicable laws and regulations while using the Services.

10. Intellectual Property
10.1 All content, materials, and software included in the Services are protected by copyright and other intellectual property rights owned by SHUA or its licensors.

10.2 Except as expressly authorized, copying, distributing, or using any part of the Services in any manner is strictly prohibited.

10.3 SHUA®, the SHUA logo, and other product or service marks are trademarks of SHUA. Use of any of these trademarks without prior written consent is strictly prohibited.

11. Governing Law and Dispute Resolution
11.1 The Services are provided from within China, and these Terms shall be governed by the laws of the People’s Republic of China, excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

11.2 Notwithstanding the above, if applicable law grants consumers the right to submit disputes to the courts in their place of residence, such provisions shall take precedence.
